Res Judicata is one of the fundamental principles of the international arbitration system, applied to ensure the stability and finality of arbitral awards and to prevent re-litigation. Nevertheless, it is worthy of consideration whether circumstances may be envisaged in which the application of all the effects of the Res Judicata doctrine becomes untenable. Adopting an analytical and comparative approach, and mindful of the existing gaps in the laws andregulations governing international arbitration, as well as the evident shortcomings in contemporary legal scholarship, this article seeks to examine and elucidate the exceptions to this doctrine by studying the practical practice of international arbitral tribunals in cases where arbitral tribunals have declined to give effect to the consequences of the Res Judicata principle. An analysis of this issue, together with reliance on the applicable legal rules, leads to the conclusion that, notwithstanding the elevated status of Res Judicata as one of the fundamental pillars of the effectiveness of the arbitral system, international arbitral tribunals, in certain circumstances, including fraud in the arbitral proceedings, the issuance of a rectifying award, conflict between an arbitral award and public order, the presentation of new evidence, a subsequent change in the legal or factual circumstances, lack of jurisdiction of the arbitral tribunal, and failure to observe the principles of fair trial, may decline to give full effect to this principle and recognize exceptions thereto. Recognition of such exceptions prevents the effectiveness of arbitration from being undermined and contributes to enhancing the legitimacy, flexibility, and trust in the international arbitration system.
