چکیده
مبنای پذیرش «اصل صلاحیت مبتنی بر تابعیت بزهدیده»، «حمایت از اتباع بزهدیده» است که بر پایه آن، دادگاههای کشور متبوع بزهدیده تحت شرایطی صلاحیت رسیدگی مییابند. اصل مزبور در حقوق ایران، جز در برخی موارد، به عنوان یک اصل تعیینکننده اعمال قوانین کیفری مورد پذیرش قرار نگرفته بود. این در حالی است که بسیاری از کشورهای دیگر از دیرباز این اصل را پذیرفته و هماکنون نیز در نظامهای حقوق داخلی و بینالمللی استناد به آن در حال گسترش است. با عنایت به عدم مغایرت این اصل با موازین شرعی و قانون اساسی جمهوری اسلامی ایران و مشروعیت آن در سطح بینالمللی، ماده (8) قانون مجازات اسلامی مصوب 1392 اصل مزبور را مورد پیشبینی قرار داده است که گام مؤثری در حمایت از اتباع ایرانی به شمار میرود. بررسی میزان تأمین منافع اتباع ایرانی از طریق پیشبینی این اصل، جایگاه این اصل در جدال با سایر اصول اعمال صلاحیت و نحوه تعامل اصل موصوف با سایر کشورهای دارای صلاحیت، موضوعی است که در این مقاله به آن پرداخته شده است.

The basis of accepting the passive personality principle is to protect victimized nationals. In the face of special provisions and circumstances, his/her country has jurisdiction. This principle, in Iran law system, had been accepted in limited areas. While several countries have accepted this principle for a long time and referring to it is expanding in national and international law. This principle is not in conflict with Sharia rules and the Constitution of the Islamic Republic of Iran. Then, according to its legitimacy in international level, this principle has been legislated in Article 8 of Islamic Penal Code of Iran. It can be an effective measure to protect nationals.
This study is considering how this principle can protect nationals' interests, the challenge of this principle with other principles and the way it interacts with other countries which have jurisdiction over the case.
