The conceptology of hate crimes is the first step in policy making in the field of these crimes in order to prevent their occurrence and formulate appropriate laws and regulations. In fact, the knowledge of these crimes is not only because of their indisputable nature, but also because of determining the policies of the policymakers, as well as the knowledge of the victim and other activists involved in it, is a key issue in formulating official and unofficial policies and responses. In this article, the concept of hate crime in the policymaking circles of Iran and the United States has been comparatively examined using a descriptive analytical method. It has also been tried to analyze the existing concept and the conceptual needs of these crimes. The concept of these crimes in both countries is the result of political discourses and the historical background of various movements, activities and events against groups with different characteristics from others, and since the formulation of laws and other policies regarding These crimes have little history in Iran, compared to its concept in America, it has less maturity and streamlining ability in the field of criminal policy. In addition, the limited scope of this crime in the policy field of Iran reduces the possibility of supporting the victims of these crimes, while the concept of these crimes presented in the United States is a broad, victim-oriented concept and has a suitable capacity for the exploitation of policy makers.
