The experience of World War II was paired with the depreciation of rights of their essence and significance. This resulted in guaranteeing the right to free development of personality in Germany. The right to free development of personality is rooted in the acknowledgment of human reason, will, and responsibility as the three fundamental elements that are responsible for shaping an individual’s desired path in life. This right emerged as an important foundation in the reconstruction of the shattered sanctity of an individual person in that era. between the 19th century and the 20th century, legal systems effectively became a testing ground for the challenge of guaranteeing rights in an effective manner. The very foundations of all theories built on rights and freedoms faced a great challenge. The question was, how could rights, with their unique nature, create practical means for the upholding of these values? The solution appeared in the judicial procedures. The Federal Constitutional Court of Germany played an important role in this realm. Showcasing one of the most influential examples of guaranteeing rights. The recognition and the protection of the right to free development of personality stands out as one of the most prominent of these examples. The free development of personality as one of mankinds core foundational aspects, encompassing its biological structures, identity, reputation, and its societal standing point, has been the subject of numerous disputes. Furthermore, the significance of judicial procedures is not limited to national legal systems. On a European level, the establishment of the European Court of Human Rights has provided an additional layer in the protection of rights. This exchange between the Federal Constitutional Court of Germany and the European Court of Human Rights has had influence on the domain of the right to free development of personality.
