Civil Liability of Artificial Intelligence with an Economic Efficiency Approach

Abstract
The legal literature related to Artificial Intelligence (AI) has grown significantly in recent years. This novel phenomenon, similar to industrialization, while offering benefits, also poses risks, including the potential for civil liability arising from AI. AI systems are characterized by their complexity and independent functioning, necessitating the establishment of liability rules governing their actions in pursuit of corrective justice.
Over time, AI systems will operate in a fully autonomous manner. However, even in this scenario, the role of human actors cannot be ignored. This indicates that providing appropriate incentives to involved human parties remains crucial in mitigating AI-related damages. Therefore, regulations governing civil liability should be designed in a way that incentivizes those involved in the production and use of AI to effectively reduce the social costs of potential incidents.
One of the most important actors overlooked in the legal literature of this field is AI developers and managers. Based on the economic efficiency approach, the findings of this research indicate that the theories of strict liability and negligence, respectively, for developers and managers can lead to economic efficiency.
