از سکوت تا روایت؛ تحلیل جنبش «من‏ هم» (می تو) به مثابه عدالت روایی

چکیده
این پژوهش با تمرکز بر مفهوم «عدالت روایی»، به واکاوی دستاوردها و چالش‌های جنبش «من‏ هم» می‌پردازد. این جنبش با برجسته ساختن حق روایتگری قربانیان خشونت جنسی، به یک کنش سیاسی و جمعی تبدیل شد. با این‏حال، این مقاله با رویکردی تحلیلی-توصیفی نشان می‌دهد که این حرکت، با وجود دستاوردهای گفتمانی، اغلب در مرحله «افشاگری» باقی مانده و با پارادوکسی بنیادین در عدالت کیفری روبرو شده است: تقابل میان حق بر شنیده شدن قربانی و حق بر بی‏ گناه فرض‏ شدن متهم. این پژوهش با نقد راه‌حل تاریخی، یعنی سرکوب یا خاموش کردن روایت‌ها به سود فرض برائت، نتیجه می‌گیرد که رویکرد منصفانه، در برقراری توازنی نهفته است که به نحوی نسبتاً مطلوب هر دو حق را تضمین نماید. نظام عدالت کیفری موظف است از حق بنیادین برائت و لزوم اثبات اتهام ورای هرگونه شک معقول، حمایت کند؛ همان‌طور که باید حق بنیادین قربانیان را برای شنیده‌شدن و دادخواهی به رسمیت بشناسد. این الگوی پیشنهادی، گرچه یقیناً تمام پیچیدگی‌ها را حل نمی‌کند، دست‏ کم به جای بستن این پارادوکس به سود یک طرف، آن را به شکلی مسئولانه و عادلانه «باز» نگه می‌دارد.

From Silence to Narration: An Analysis of the Me Too Movement as Narrative Justice

چکیده English

Focusing on the concept of “Narrative Justice”, this study examines the achievements and challenges of the Me Too movement. By highlighting the victims’ right to narrate their experiences of sexual violence, this movement evolved into a collective and political action. Nevertheless, adopting a descriptive–analytical approach, this article demonstrates that, despite its discursive achievements, this movement has largely remained at the stage of “disclosure” and has encountered a fundamental paradox in criminal justice: the tension between the victim’s right to be heard and the accused’s right to be presumed innocent. By criticizing the historical solution, namely the suppression or silencing of narratives in favor of the presumption of innocence, this study concludes that a fair approach lies in establishing a balance that can relatively adequately safeguard both rights. The criminal justice system is obliged to protect the fundamental right to the presumption of innocence and the requirement that accusations be proven beyond any reasonable doubt and, at the same time, it must recognize the fundamental right of victims to be heard and to seek justice. This proposed model certainly does not resolve all complexities; rather, instead of closing this paradox in favor of one side, it keeps the paradox “open” in a responsible and fair manner.
