Security of Wages and Financial Rights of Workers in the Event of the Employer Bankruptcy (with Emphasis on International Labor Organization Documents)

Abstract
One of the significant issues arising in the relationship between workers and employers is the employer’s insolvency or bankruptcy and its implications for the payment of workers’ wages and other monetary entitlements, which constitutes a serious threat to the realization of workers’ financial rights. This article examines the issue using a descriptive-analytical method and based on information collected through library-based (documentary) research. ILO Conventions Nos. 95 and 173 and Recommendations Nos. 85 and 180, with a view to protecting workers’ claims in cases of employer insolvency and bankruptcy, provide two mechanisms: according priority status to workers’ claims and giving them precedence over the claims of other creditors; and establishing a special fund with an insurance-based character to guarantee the payment of workers’ claims in cases of employer insolvency and bankruptcy. This article examines the extent to which the legal system of Iran conforms to the standards of the International Labour Organization. An examination of the relevant sources within the legal system of Iran indicates that the first mechanism has been adopted to protect workers’ wage claims. Nevertheless, the mechanism adopted is incomplete, as it does not cover all of workers’ rights and monetary claims, including compensation and length-of-service entitlements, and does not even provide adequate protection for workers and employers in circumstances of financial crisis.
