The Legal Aspects of Related Contracts with an Emphasis on the Draft Common Frame of Reference

Abstract
Linked contracts refer to a set of independent contracts entered into sequentially by identical or different parties for the purpose of executing the main contract, without replacing one another. These contracts, by virtue of sharing a common objective, form a unified whole. Consequently, the termination of the main contract results in the termination of the other contracts as well. In the Draft Common Frame of Reference (DCFR), the concept of linked contracts is introduced within the context of consumer contracts. According to this framework, when the right of withdrawal from the contract is exercised, the related credit contracts associated with the main contract are also terminated. This research, conducted using a descriptive-analytical method and by collecting information from library sources, seeks to answer the question: under what conditions in the DCFR can two separate contracts be considered linked, and how can the effect of terminating one be extended to the other? The findings of the study indicate that the criterion for linking two or more contracts is the existence of contractual interdependence in terms of performance and economic aspects. Although, on the face of it, only a limited group of credit contracts-those concluded remotely or in situations where a party needs to reconsider its decision regarding the continuation of the contract—are covered by this law, as evidenced in German and French law, the rules of linked contracts can also be applied to other types of contracts.
