This study, conducted using a descriptive-analytical methodology and a comparative approach, drawing upon both library-based and online resources, focuses on examining the transformative effects of self-executing contracts on the contractual regime. The principal question that this study seeks to answer is the extent to which this innovation is capable of transforming the formal and substantive structure of contracts. The findings indicate that the lack of precision in the use of technical terms and specialized concepts, such as artificial intelligence, blockchain, and even the contract, constitutes one of the principal obstacles to a proper understanding of this phenomenon. Transformations in the linguistic and syntactic structures of contracts, the adoption of conditional logic, the reduction of the adverse effects of human judgment and emotions, and the diminished reliance on public authority in the performance of contracts are among the principal formal and substantive changes brought about by the smart contract paradigm. Nevertheless, despite its aforementioned capacities and advantages, this paradigm has not gained widespread acceptance owing to its excessive complexity. پدیده موســوم به قرارداد هوشــمند از جمله موضوعات فناورانه ای محســوب می شــود که طی ســالیان اخیر در محافل علمی و رســانه ای توجه زیادی را به ســوی خود جلب نموده اســت. مطالعه حاضر که بــا بهره گیری از روش توصیفی- تحلیلی و با رویکرد مقایســه ای به مدد ابزارهای کتابخانه ای و اینترنت انجام گردیده اســت، بر بیان آثار تحولی قراردادهای خود اجرا تمرکز نموده اســت. پرسش اصلی که پژوهش حاضر درصدد یافتن پاســخی مناســب برای آن می باشد، این اســت که نوآوری مذکور تا چه میزان قادر اســت ساختار شکلی و ماهوی قراردادها را متحول نماید. یافته ها حکایت از ایــن دارد که عدم دقت در زمینه کاربرد دقیــق کلمات و واژگان تخصصی مانند هوش مصنوعی، بلاک چین و حتی قرارداد، از جمله عوامل بازدارنده در شــناخت دقیق پدیده مذکور اســت؛ دگرگونی در ساختارهای زبانی و دستوری قراردادها، حاکم نمودن منطق شــرطی، کاهش تاثیرات افکار واحساسات مخرب انسانی و کاهش وابستگی به قدرت عمومی در فرایند اجرای قراردادها از اهم تحولات شــکلی و ماهوی اســت که در پرتو الگوواره قراردادهای هوشــمند حاصل شده است و الگوواره مذکور به رغم برخورداری از ظرفیت هــا و توانمندی های پیش گفته، به علت پیچیدگی بیش از حد، با اقبال عمومی مواجه نشده است. https://www.jlj.ir/article_737520_e08dafd0ecd91e2dda96b8d329d381e8.pdf
