These decisions, which are referred to by terms such as interim decisions, decisions on precautionary measures, and also partial awards, address important issues during the stages of the constitution of the arbitral tribunal, the conduct of arbitral proceedings, the issuance of the award, and its recognition and enforcement, which may affect the structure of the main award. Employing a descriptive-analytical method and a comparative approach, this research, in response to the question of what constitutes the concept, conditions for issuance, and effects of a partial award as one of the types of arbitral awards, concludes that, despite the fact that the national laws of certain countries and institutional arbitration rules have expressly or implicitly recognized the permissibility of issuing such an award, no provision appears to have been established in the law of Iranian in this regard. Nevertheless, upon closer examination of the existing provisions, the permissibility of issuing such an award can be inferred. در برخی موارد، شــرایط صدور رأی توسط داور، ناظر به موضوع هایی است که شــاید مقصود اصلی طرفین از مراجعه به داوری نباشــد، اما برای شروع یا امکان ادامه جریان داوری ضروری اســت. این تصمیم ها که با عناوینی نظیر تصمیم میانی، تصمیم های مربوط به اقدامات احتیاطی و همچنین رأی جزئی تعبیر می شود، مباحث مهمی را در زمان تشــکیل، جریان داوری، صدور رأی، شناسایی و اجرای آن به خود اختصاص می دهد که ممکن است شاکله رأی اصلی را تحت تأثیر قرار دهد. پژوهش حاضر با روش توصیفی- تحلیلی و رویکرد تطبیقی، در پاســخ به این سؤال که مفهوم، شــرایط صدور و آثار رأی جزئی به عنوان یکی از اقسام آرای داوری چیست، نتیجه می گیــرد که به رغم قوانین ملی بعضی از کشــورها و قواعد داوری ســازمانی که به صراحت یا به طور تلویحی صدور این نوع رأی را مجاز شــناخته اند، در قوانین ایران به ظاهر مقرره ای در این خصوص مشاهده نمی شود، اما با تدقیق در مقررات موجود می توان جواز صدور چنین رأیی را استنباط نمود. https://www.jlj.ir/article_735213_69031ec727342caaa55cf2e6bc2a702d.pdf
