In the Iranian legal system, it is applied as a last resort for a situation where the convict is not willing to execute the convictions in any way and no property is found from him. The jurists - and following them the Iranian legal system - have always been cautious in this regard and the legislator is under different assumptions such as filing a petition for insolvency or finding property of the convict, and denies his/her detention. In this paper, we examine the conditions and challenges to the detention of a convicted person in civil matters and we will discuss the legal and practical problems of the issue. Rare cases in which the possibility of detaining a convicted person is not explicitly stated by law, including arbitral awards, foreign awards, restoration of executive operations and the impossibility of enforcing an objective award, are examined in this article, relying on judicial procedure and practical problems. بازداشت محکوم‌علیه مالی در امر مدنی به‌عنوان امری استثنایی تلقی می‌شود که در نظام حقوقی ما به‌عنوان آخرین راهکار برای حالتی که محکوم‌علیه به هیچ عنوان حاضر به اجرای حکم نباشد و اموالی از وی یافت نشود، اعمال می‌گردد. فقها و با تأسی از ایشان نظام حقوقی ما، در این مقوله همواره محتاط بوده و به هر صورت قانون‌گذار تحت فروض مختلفی از قبیل تقدیم دادخواست اعسار یا یافته شدن اموالی از محکوم‌علیه، بازداشت وی را منتفی می‌داند. در این مقاله به بررسی شرایط و موانع بازداشت محکوم‌علیه ممتنع در امر مدنی پرداخته و ایرادات وارده بر موضوع را به بحث خواهیم گذاشت. موارد نادری که امکان بازداشت محکوم‌علیه در مورد آن‌ها به‌موجب قانون به‌صراحت مطرح نشده، ازجمله رأی داوری، احکام خارجی، اعادۀ عملیات اجرایی و عدم امکان اجرای حکم عینی، در این مقاله با تکیه بر رویۀ قضایی و مشکلات عملی مورد بررسی قرار می‌گیرد. https://www.jlj.ir/article_245423_debb76bdb60a569765e68fd907bd9539.pdf
