According to this principle, investigation of all crimes lies on independent official named judge d'instruction and prosecution of the offences, after performing the pre-trial investigation lies on prosecutor. In accusatory systems, all both of the prosecution and the investigation of the crimes is carried out by the prosecutor. In the former systems, because of the presence of the investigator, prosecutor or the other judicial ones as prosecutor, restrain from intervening in investigation and by the end of investigation, the prosecutor takes over the prosecution of crime in the court. Iranian legislator, although in recent developments in this field accepted the inquisitory system in pre-trial stage, but never has been bounded to the absolute separation prosecutor from investigator that is determination of mix hearing system and in many times, deviated from this principle so that in criminal procedure code 1392, expanded the scope of deviation from this principle and as well as prosecutor, qualified the other judicial ones for performing the pre-trial یکی از اصول حاکم بر نظام‌های دادرسی مختلط، حاکمیت اصل تفکیک مقام تعقیب از مقام تحقیق در مرحله تحقیقات مقدماتی می‌باشد. بر اساس این اصل، انجام تحقیقات مقدماتی تمامی جرایم بر عهده مقام مستقلی به نام قاضی تحقیق یا بازپرس بوده و تعقیب جرم نیز متعاقب انجام تحقیقات مقدماتی بر عهده مقام تعقیب یا دادستان می‌باشد. قانون‌گذار کشور ایران، هرچند در وضع و تصویب قانون آیین دادرسی کیفری 1290 با الهام از قانون کشور فرانسه، سیستم تفتیشی را در مرحله تحقیقات مقدماتی پذیرفته بود، لیکن هیچ‌گاه به انفکاک و جدایی مطلق مقام تعقیب از مقام تحقیق که شاخصه بارز نظام دادرسی مختلط است، پای‌بند نبوده و در موارد عدیده‌ای از این اصل عدول نموده بود؛ به‌نحوی که به هنگام تصویب قانون آیین دادرسی کیفری 1392 و نیز در اصلاحات سال 1394، دامنه عدول از اصل مذکور را گسترش داده و به غیر از دادستان، مقامات قضایی دیگری را نیز واجد صلاحیت برای انجام تحقیقات مقدماتی دانسته است. سلب انجام تحقیقات مقدماتی از بازپرس در برخی از جرایم مهم و طرح مستقیم پرونده در دادگاه به‌همراه افزایش رسیدگی اختصاری به جرم، و نیز حفظ قیمومت دادستان نسبت به بازپرس قبل، حین و پس از انجام تحقیقات مقدماتی، از مهم‌ترین موارد عدول از اصل تفکیک مقام تعقیب از مقام تحقیق می‌باشد. https://www.jlj.ir/article_18912_a68cb11c77763c9de8861dd0dd2eaee5.pdf
