قوه قضائیه مجله حقوقی دادگستری 1735-4358 74 70 2010 06 01 The Effect of the Injured Party’s Condition on The Agent’s Responsibility تأثیر حالت و وضعیت زیان‌دیده بر مسؤولیت عامل زیان 111 131 11177 10.22106/jlj.2010.11177 FA مهدی خادم سربخش Journal Article 2015 01 06 In cases of damage, we sometimes face a situation in which the physical, mental, social and economic conditions of the injured party can influence the damage or its amount; in these cases, the question is can the agent rely on these conditions to reduce his responsibility and if yes, under what circumstances. It seems that, considering the general inclination in the most of the legal systems in the world, it is better to distinguish among different conditions of the injured party. Also, we should believe that the agent can rely on these conditions to relieve his responsibility in two occasions. First, when the physical, mental, social and economic conditions of the injured party causes the damage such that if he/she had not been in that conditions there would have been no damage. Second, when the social and economic conditions of the injured party aggravates the damage. However, in these cases the intention of the agent or prediction of the injured party’s condition by the agent, prevents the influence of this condition on the agent. <span class="1"><span lang="FA">در ورود خسارت به زیان‌دیده، گاه به مواردی برخورد می‌کنیم که شرایط فیزیکی، روانی، اجتماعی و اقتصادی زیان‌دیده به‌گونه‌ای است که می‌تواند در ورود یا افزایش خسارت وارده به وی مؤثر باشد؛ در این موارد، این پرسش مطرح می‌شود که آیا عامل ‌زیان می‌تواند برای کاهش بار مسؤولیت خود به این حالات استناد کند و در صورت مثبت بودن پاسخ، تحت چه شرایطی این امر امکان‌پذیر است؟ </span></span> <span class="1"><span lang="FA" dir="RTL">به نظر می‌رسد، با توجه به تمایل عمومی حاکم بر اغلب نظام‌های حقوقی جهان، بهتر است میان صور حالت و وضعیت زیان‌دیده تفاوت گذاشته شود. همچنین باید به این نتیجه قائل شد که عامل زیان در دو صورت می‌تواند برای رهایی خویش از مسؤولیت به این حالات و شرایط استناد کند. نخست آن‌که، حالت جسمی، روانی و وضعیت اجتماعی و اقتصادی زیان‌دیده سبب ورود خسارت شود؛ به نحوی‌که، اگر زیان‌دیده در این شرایط نمی‌بود، هیچ خسارتی نیز به بار نمی‌آمد. دیگر آن‌که، وضعیت اجتماعی و اقتصادی زیان‌دیده سبب افزایش خسارت شود. با این وجود، در این موارد نیز عمد عامل زیان و یا پیش‌بینی حالت و وضعیت زیان‌دیده توسط شخص عامل، مانع تأثیر‌گذاری این حالت و وضعیت  بر مسؤولیت عامل زیان می‌شود.</span></span> https://www.jlj.ir/article_11177_296b62d0af509baab599abe4af78ae8c.pdf
