Meanwhile, due to the need to protect its citizens, the Islamic Republic of Iran, given the severity of the harm done to the Iranian victims of chemical attacks and their families, has the task of facilitating the litigation of these individuals from the perpetrators of the attacks. In this regard, the judiciary is also of a pivotal task for facilitating the domestic litigation of Iranian victims of chemical attacks through internal judicial mechanisms. In this framework, although the domestic courts have competence to proceed in this case, but with regard to the non-criminalization of international crimes in Iran's domestic laws, the criminal or civil litigation of Iranian chemical victims and their families from Iraqi authorities and also, the people who helped the Iraqi Ba'ath army to achieve chemical weapons are subjected to the exact criminalization of international crimes, including the use of chemical weapons as an example of war crimes. On the other hand, according to the principle of judicial immunity of states, only the international responsibility of the United States for helping the Iraqi army to be armed with chemical weapons is litigious before the domestic courts of Iran, within the framework of the principle of countermeasure.}, keywords = {Chemical Weapon,Individual Criminal Responsibility,International Responsibility of States,Competence of Internal Court,reciprocity}, title_fa = {راهکارهای دادخواهی قربانیان سلاح‌ شیمیایی در جنگ تحمیلی در نظام قضایی جمهوری اسلامی ایران}, abstract_fa = {یکی از عمده­ ترین مصادیق به‌کارگیری سلاح شیمیایی در جریان مخاصمات مسلحانه مدرن، استفاده گسترده ارتش عراق از آن در جنگ تحمیلی بر علیه رزمندگان و غیرنظامیان ایرانی و حتی اتباع عراقی می­باشد که در نتیجه آن هزاران تن شهید و یا مصدوم گردیده اند. در این میان و به سبب لزوم حمایت یک دولت از اتباع خود، جمهوری اسلامی ایران هم با توجه به شدت آلام و آثار زیان‌بار وارده بر قربانیان ایرانی حملات شیمیایی عراق و خانواده ­های ایشان، وظیفه تسهیل دادخواهی این افراد از مرتکبان حملات مزبور را بر عهده دارد. در همین راستا قوه قضاییه نیز به عنوان رکن قضایی کشور، تکلیف به تسهیل و مساعدت در دادخواهی داخلی قربانیان ایرانی حملات شیمیایی عراق از طریق سازکارهای قضایی داخلی را بر عهده دارد. در این چارچوب، گرچه صلاحیت لازم برای ورود دادگاه‌های داخلی در این حوزه وجود دارد، اما با توجه به عدم جرم انگاری جنایات بین­ المللی در قوانین داخلی ایران، دادخواهی کیفری یا مدنی مصدومان شیمیایی ایرانی و خانواده­ های ایشان از مقامات وقت عراق و همچنین افراد کمک‌کننده به تسلیح شیمیایی ارتش بعث عراق منوط به جرم­ انگاری دقیق جنایات بین­ المللی و از آن جمله، جرم به‌کارگیری سلاح شیمیایی به عنوان مصداقی از جنایت جنگی می­باشد. از سوی دیگر، با توجه به اصل مصونیت قضایی دولت‌ها نزد دادگاه­ های یکدیگر، در حال حاضر تنها طرح مسئولیت بین ­المللی دولـت آمـریـکا در دادگـاه‌های داخـلی ایـران از جـهت کمـک به تسـلیح ارتش عراق به سلاح‎های شیمیایی، آن هم در چارچوب اصل عمل متقابل امکان­پذیر خواهد بود.}, keywords_fa = {سلاح شیمیایی,مسئولیت کیفری فردی,مسئولیت بین المللی دولت,صلاحیت دادگاه داخلی,عمل متقابل}, url = {https://www.jlj.ir/article_34675.html}, eprint = {https://www.jlj.ir/article_34675_2b52f6c2ab722970ed764f3cf96148d3.pdf} }
