This basic principle is explicitly or implicitly mentioned in many countries’ statutes today. Of course, in criminal law, unlike other areas of law, especially private law, good faith is a less recognized concept and in practice neglected by many writers and researchers. In the literature of Iranian criminal law and in comparison, with Western and Arab countries, the principle of good faith is not properly explained. Although the legislature has implicitly noted goodwill in some areas, including legal excuses, mitigating circumstances, and justifiable causes of committed acts, he does not explicitly refer to this concept; In addition, the criteria for identifying good faith and the criteria for recognizing it have not been clarified. According to the legal doctrine, some judicial officials pay attention to the perpetrator’s good faith while writing the verdict and are in the position of justifying the reason for modifying or changing the title of the accusation and also changing the type and amount of criminal response. In the general theory of crime, good faith finds meaning around the perpetrator's intent and reveals its effect specifically in relation to criminal guilt; in such a way that by proving the absence of malice, the person’s good faith in the status of execution or exercise of the right is defended. The research method in this article is descriptive-analytical and at the same time comparative and library tools have been used to collect subjects.}, keywords = {Principle of Good faith,Criminal law,Legal Doctrine,Intention,Criminal Guilt}, title_fa = {بررسی جایگاه و نقش اصل حُسن‌نیت در حقوق کیفری}, abstract_fa = {حسن‌نیت به عنوان یک اصل کلی حقوقی، در همۀ شاخه‌های علم حقوق از موقعیت ممتاز و ویژه‌ای برخوردار است. امروزه در قوانین بسیاری از کشورها به شکل صریح یا ضمنی به این اصل پایه اشاره شده است. البته در حقوق کیفری، برخلاف دیگر حوزه‌های حقوقی و به‌ویژه حقوق خصوصی، حسن‌نیت مفهومی کمتر شناخته‌شده و در عمل مغفول برای بسیاری از نویسندگان و پژوهشگران بوده است. در ادبیات حقوق کیفری ایران و در مقایسه با کشورهای غربی و عربی، اصل حسن‌نیت به درستی تبیین نشده است. اگرچه قانون‌گذار به طور ضمنی در برخی حوزه‌ها از جمله معاذیر قانونی، کیفیات مخفّفه و اسباب اباحۀ رفتار ارتکابی به حسن‌نیت توجه داشته، اما به صراحت به این مفهوم اشاره‌ای نداشته است؛ ضمن آنکه ضوابط‌ شناسایی حسن‌نیت و سنجه‌های تشخیص آن نیز روشن نگردیده است. تنها بر اساس دکترین حقوقی، برخی از مقام‌های قضایی ضمن انشای رأی و در مقام توجیه چرایی تعدیل یا تبدیل عنوان اتهامی و نیز تغییر نوع و میزان واکنش کیفری به حسن‌نیت مرتکب توجه می‌کنند. در نظریۀ عمومی جرم، حسن‌نیت حول محور قصد مرتکب معنا می‌یابد و به طور خاص در ارتباط با تقصیر جزایی، اثر خود را آشکار می‌سازد؛ به‌گونه‌ای که با اثبات نبودِ سوءنیت، حسن‌نیت شخص در مقام اجرا یا استعمال حق مورد دفاع واقع می‌شود. روش تحقیق در این پژوهه، توصیفی ـ تحلیلی و در عین حال تطبیقی است و از ابزار کتابخانه برای گردآوری مطالب استفاده شده است.}, keywords_fa = {اصل حسن‌نیت,حقوق کیفری,دکترین حقوقی,قصد,تقصیر جزایی}, url = {https://www.jlj.ir/article_254800.html}, eprint = {https://www.jlj.ir/article_254800_defea4456f68c45d92971779ca2616d0.pdf} }
