In case, the proceeds of the credit are assigned to third party by the beneficiary through the discount of the credit and it is later discovered that the beneficiary had committed fraud, so in such a case, this question arises whether in Iranian legal system, the third party assignee shall be immune from the effects of fraud committed by the beneficiary? In this regard, some believe that according to the general rule that "no one can transfer to another more rights than he has", the assignee of proceeds shall not be immune from the effects of fraud. From a comparative law perspective, there are two profoundly different approaches concerning the impact of fraud on the rights of the assignee of proceeds. According to the first approach accepted in the English legal system, an assignee of proceeds shall not be immune from fraud, even if it is considered as a bona fide holder. However, according to the second approach which is reflected in Section 109 of Article 5 of the US Uniform Commercial Code, the assignee shall be immune from fraud on condition that it is considered as a bona fide holder. In Iranian legal system, although there is no specific law in the field of documentary credits, such a person must be immune from the effects of fraud having regard to the banking practice, case law, and legal doctrine, as this is requisite for maintaining the commercial utility of letter of credit as an important financing mechanism.}, keywords = {Letter of Credit,fraud,Discount,Assignee of Proceeds,Issuing Bank}, title_fa = {تأثیر تقلب بر حقوق انتقال‌گیرندۀ عواید حاصل از اعتبار اسنادی در نظام حقوقی ایران با تحلیل تطبیقی یک پروندۀ قضایی}, abstract_fa = {تقلب به عنوان استثنائی بر اصل استقلال اعتبار اسنادی از قرارداد پایه یکی از چالش‌های کلیدی پیش‌روی بانک گشایش‌کنندۀ اعتبار می‌باشد که به طور خاص در اعتبارات اسنادی مدت‌دار بیشتر در کانون توجه می‌باشد. چنانچه عواید حاصل اعتبار قبل از سررسید توسط ذی‌نفع از طریق تنزیل اعتبار به شخص ثالثی واگذار شود و بعداً کاشف به عمل آید که ذی‌نفع مرتکب تقلب شده است، در چنین حالتی این سؤال مطرح می‌شود که آیا در نظام حقوقی ایران شخص ثالث انتقال‌گیرندۀ عواید مصون از آثار تقلب صورت گرفته توسط ذی‌نفع خواهد بود؟ در این باره برخی اعتقاد دارند که طبق قاعدۀ کلی که «هیچ‌کس نمی‌تواند بیش از آنچه داراست به دیگری انتقال دهد»، انتقال‌گیرندۀ عواید مصون از تقلب نخواهد بود. از منظر حقوق تطبیقی، در ارتباط با تأثیر تقلب بر حقوق انتقال‌گیرندۀ عواید حاصل از اعتبار اسنادی دو دیدگاه کاملاً متفاوت وجود دارد. بر اساس دیدگاه اول که در نظام حقوقی انگلستان پذیرفته شده است، شخص ثالث انتقال‌گیرندۀ عواید حتی اگر با حسن‌نیت باشد، مصون از تقلب نخواهد بود حال آنکه بر طبق دیدگاه دوم که در بخش 109 از مادۀ 5 مقررات متحدالشکل تجاری آمریکا منعکس یافته، انتقال‌گیرنده به شرط دارا بودن حسن‌نیت مصون از تقلب می‌باشد. در نظام حقوقی ایران، گرچه قانون خاصی در حوزۀ اعتبارات اسنادی وجود ندارد لیکن بر اساس عرف بانکی، رویۀ قضایی و نظریۀ اندیشمندان حقوقی چنین شخصی باید مصون از آثار تقلب باشد، زیرا این امر لازمۀ حفظ مطلوبیت تجاری اعتبار اسنادی به عنوان یک مکانیزم مهم تأمین مالی می‌باشد.}, keywords_fa = {اعتبار اسنادی,تقلب,تنزیل,انتقال‌گیرندۀ عواید,بانک گشایش‌کننده}, url = {https://www.jlj.ir/article_242908.html}, eprint = {https://www.jlj.ir/article_242908_7721bcfa9c3a88f928470e9c4432cc12.pdf} }
