Abstract
Artificial intelligence and AI-based productions, owing to their emerging and novel nature and their unique characteristics and inherent capabilities, in addition to their unparalleled advantages, can create risks, challenges, and dangers for actors in this field. Therefore, legal scholars have sought to regulate and formulate policies and coverage appropriate to the specific risks of artificial intelligence. In this regard, Western and European countries have envisaged various legal mechanisms; however, so far no comprehensive mechanism has been developed to ensure compensation for damages arising from artificial intelligence. This article, using a descriptive-analytical approach, proposes an insurance institution as a solution to guarantee the interests of users of artificial intelligence in order to protect the insured against its economic consequences, risks, and possible harmful damages. The components of the insurance mechanism for losses caused by artificial intelligence include: adapting the insurance contract to the characteristics of artificial intelligence, entrusting specific elements of artificial intelligence insurance policies to insurance companies, classifying liability and the risks arising from it and insuring based on this classification, creating the necessary infrastructure with government supervision, and mandatory insurance of major artificial intelligence-based products.
