چکیده

با تصویب قانون مجازات اسلامی 1392، تأکید مقنن بر پاسخ‌های جایگزین اجتماع‌مدار به اطفال و نوجوانان بزهکار، جایگاه ویژه‌ای پیدا کرده است. این جایگزین‌های اجتماعی در مصادیقی چون تبصرۀ بند الف مادۀ 88 با عنوان دستورهای حین تسلیم، تصمیمات مقرر در مادۀ 88، مجازات‌های مقرر در مادۀ 89 ناظر به نوجوانان و تصمیمات قضایی ارفاق‌آمیز مقرر در مواد 90 و 94 این قانون، مبین رویکرد نوین قانون‌گذار در فاصله‌گرفتن از پاسخ‌های کیفری به این دسته از بزهکاران است. هرچند که رویکرد تقنینی مذکور در قالب سیاست جنایی اصلاح‌مدار اجتماعی، نویدبخش رویکرد قضات به سمت اِعمال پاسخ‌های مبتنی بر مراقبت، اصلاح، درمان، بازپروری اطفال و نوجوانان بزهکار است، اجرای عملی و قضایی این رویکرد اصلاحی و اجتماعی، با مشکلات متعددی مواجه خواهد بود. این در حالی است که اِعمال چنین پاسخ‌هایی در حقوق کیفری انگلستان متنوع بوده و در برخی مصادیق، قریب به سه دهه سابقه دارند و همچنین به‌لحاظ اجرایی، تجربیات و نکات کاربردی متعددی از رویکرد تقنینی و قضایی این کشور، قابل‌اتخاذ است. تبیین اینکه چه مصادیقی ذیل این پاسخ‌های اجتماعی قرار می‌گیرند و برای صدور آن‌ها چه شرایطی لازم است و همچنین ضمانت‌اجراهای هر کدام شامل چه مواردی می‌شوند، می‌تواند در مقام اجرای اثربخش این پاسخ‌های نوین، نقش بسزایی داشته باشد.

چکیده [English]

By enacting the Islamic Panel code (act 2013) the Iranian legislator emphasized on the adoption of alternative community-based responses to children crime and this is known as a special attitude. This community punishment available in article 88, 89, 90 and 94 of the code, clearly shows this new attitude. The community punishment order (CPO) was first introduced as the community service order under the provisions of the Criminal Justice Act 1972 and it is now regulated within the Powers of the Criminal Courts (Sentencing) Act 2000. The community punishment and rehabilitation order (CPRO) were introduced by the Criminal Justice Act 1991 and is now regulated within the Powers of the Criminal Courts (Sentencing) Act 2000 and is, in essence, the engagement between the community punishment order (CPO) and the community rehabilitation order (CRO). However, that legislative approach in the form of criminal policy reform social circuit judges to apply the most promising approaches based on care and correct response, but this approach has several challenges faced judicial proceedings. Effective implementation of these responses can be as effective.
