However, Article 29 of the mentioned law claims that in addition to parents, relatives are rightful to visit the child. According to the law, visitation right is mentioned in divorcement chapter and therefore this question arises that their visitation right exists only when parents are legally divorced or they also have the right when parents live apart or even when the child is under custody of both parents. To answer this question, this article is pursuing to prove that relatives who are in blood relation with the child (known as relative relatives) do not have absolute and independent visitation right; In fact, their right is conditional upon death or absence of parents, unless emotional attachment and child's interest and prudence exceptionally necessitates visitation to relatives.}, keywords = {Visitation Right,Parents,Relatives,Interest and Emotional Attachment}, title_fa = {حق ملاقات اقربا با طفل در حقوق ایران}, abstract_fa = {در ارتباط با حق ملاقات با کودک، در وجود این حق برای پدر یا مادری که پس از طلاق، حضانت به او واگذار نشده تردیدی وجود ندارد و مادۀ 29 قانون حمایت خانواده مصوب سال 91 و سایر مواد قانونی مرتبط از جمله مادۀ 1174 قانون مدنی، این حق را برای والدین شناسایی می‌کنند؛ لکن مادۀ 29 قانون مذکور علاوه بر والدین، بستگان طفل را نیز در ملاقات با او ذی‌حق اعلام کرده است. با توجه به قرارگیری این ماده در فصل طلاق، این سؤال مطرح می‌شود که آیا بستگان تنها در فرض طلاق والدین، حق ملاقات با طفل را دارند یا آنکه به غیر از این فرض، یعنی در صورتی‌که والدین طفل صرفاً جدا از یکدیگر زندگی می‌کنند یا آنکه اصلاً طفل در خانواده و تحت حضانت والدین باشد هم، اقربا حق ملاقات با طفل را دارند. این مقاله برای پاسخ به این سؤال، با روش کتابخانه‌ای در پی اثبات این فرضیه است که حق ملاقات بستگان که عبارتند از اقربای نسبی طفل، مقید به فوت یا غیبت پدر یا مادر طفل بوده و به صورت مطلق و مستقل نیست مگر اینکه مطابق مادۀ 29 قانون مذکور به‌طور استثنایی، وابستگی و مصلحت طفل، اقتضای ملاقات او را با اقربای خود داشته باشد.}, keywords_fa = {حق ملاقات,اقربا,والدین,مصلحت و وابستگی عاطفی طفل}, url = {https://www.jlj.ir/article_45771.html}, eprint = {https://www.jlj.ir/article_45771_5b9d1a9a3b5ac5ee6638f5e46bdea0e4.pdf} }
