Beneficiaries of such documents, after attending document regulator office or registering department with execution, based on the case, can pursuit the execution process via registration department. Determination of a competent authority for proceeding complaints of mentioned dual actions and the way of proceeding is one of the challenging matters in law of registration and jurisprudence. A question one may encounter is “Whether complaining execution in all cases, is in authority of the head of local registration office?” there are different answers for this question. In this research, the author will criticize the common attitude. Also while considering various articles, Supreme Court’s and High Council of Registers’ Judgments, the necessity of separation between cases, competent authority in proceeding complaints and the way of proceedings are defined. This article shows that examination of the execution process in some cases, in which they are just statements of right, without any legal aspect, is in the authority of the head of local registration office. And if there is any necessity for legal examination, the court is competent to do that.}, keywords = {Binding document,Execution order,executive operations,complaint,statement of claim,Litigation}, title_fa = {مرجع صالح و نحوۀ رسیدگی به شکایت از دستور اجرای اسناد لازم‌الاجرا و عملیات اجرایی ثبت}, abstract_fa = {یکی از امتیازات برخی از اسناد رسمی لازم‌الاجرا‌بودن آن‌هاست که در پاره‌ای از موارد بنا به مصالحی، قانون این امتیاز را به اسناد عادی هم تسری داد. ذی‌نفع اسناد مزبور می‌تواند مستقیماً حسب مورد پس از مراجعه به دفترخانۀ تنظیم‌کنندۀ سند یا ادارۀ ثبت با صدور اجرائیه (دستور اجرا)، عملیات اجرایی را از طریق ادارۀ ثبت تعقیب نماید. شناسایی مرجع صالح برای رسیدگی به شکایت از اقدامات دوگانۀ فوق و نحوۀ رسیدگی به آن، ازجمله موضوعات بحث‌انگیز در حقوق ثبت و رویۀ قضایی به شمار می‌آید؛ برای نمونه در پاسخ به این پرسش مهم که آیا شکایت از «عملیات اجرایی» در همۀ موارد در صلاحیت رئیس ادارۀ ثبت محل است، اختلاف‌نظر دیده می‌شود. در این مقاله از یک‌سو، پاسخ مرسوم به این پرسش مورد نقد قرار خواهد گرفت و از سوی دیگر، نظر به مواد مختلف قانونی و آرای دیوان عالی کشور و شورای عالی ثبت، با اثبات ضرورت تفکیک مصادیق مختلف شکایت از عملیات اجرایی، مرجع صالح در رسیدگی به شکایات مورد بحث به همراه نحوۀ رسیدگی به آن تبیین می‌شود. تحقیق پیش‌رو نشان می‌دهد که رسیدگی به اعتراض در خصوص عملیات اجرایی در مواردی که صرفاً یک اظهار حق و فاقد جنبۀ قضایی است در صلاحیت رئیس ثبت محل و در صورت ضرورت رسیدگی قضایی، در صلاحیت دادگاه قرار دارد.}, keywords_fa = {سند لازم‌الاجرا,دستور اجرا,عملیات اجرایی,شکایت,اظهار حق,ترافع}, url = {https://www.jlj.ir/article_38030.html}, eprint = {https://www.jlj.ir/article_38030_e4d00bcdd42d4f5596a1cc779d42154e.pdf} }
