This article studies the issue by the separation of two assumptions of agreement and disagreement on applicable law in contractual and non-contractual infringement of copyright in cyberspace. In contractual infringement, which has the agreement on the governing law, the procedure of most of the countries and international conventions is, acceptance of principle of will. In contractual infringement in absence of agreement on governing law, different criteria have been adopted which the most important one of them is applying the law of the country which has the closest relation with the contract. In non-contractual infringement which has been agreed on governing law, there are two general viewpoints between lawyers, countries and international regulations. Some don’t accept the principle of will because of the connection of torts with public discipline and others recognize rule of will in determination of the governing law before and after the loss. Finally in assumption of disagreement in non-contractual infringement, which is the most common kind of infringement of these right in cyberspace, among different theories (including Lex Fori, Lex Loci Delicti, Lex Loci Protectionis) the theory of the law of the closest country, has been suggested as the most appropriate solution in order to determine the governing law.}, keywords = {Conflict of Laws,copyright,Cyberspace,Governing Law}, title_fa = {تعیین قانون حاکم بر دعاوی حقوقی نقض حق مؤلف در فضای مجازی}, abstract_fa = {با انتشار آثار ادبی و هنری تحت حمایت کپی‌رایت در اینترنت و امکان نقض گستردۀ این حقوق توسط میلیون‌ها کاربر در سراسر جهان، دارندۀ حق با این پرسش مهم روبه‌رو می‌شود که در تعارض دو یا چند قانون چه قانونی بر دعوای وی علیه نقض‌کنندگان متعدد حاکم خواهد بود. آیا در تعیین قانون حاکم بر نقض حق مؤلف در محیط مجازى قواعد سنتى حل تعارض قابل‌اعمال است یا وضع قواعد جدیدی را در این حوزه می‌طلبد. این مقاله مسئله را با تفکیک دو فرض توافق و عدم توافق بر قانون حاکم در نقض قراردادی و غیر قراردادی حق مؤلف در فضای مجازی بررسی کرده است. در نقض قراردادی که بر قانون حاکم توافق شده باشد، رویۀ اکثر کشورها و نیز کنوانسیون‌های بین‌المللی پذیرش اصل حاکمیت ارادۀ طرفین است. در نقض قراردادی بدون توافق بر قانون حاکم، معیارهای متفاوتی اتخاذ شده است که مهم‌ترین آن‌ها اِعمال قانون کشور دارای نزدیک‌ترین ارتباط با قرارداد کپی‌رایت است. در نقض غیرقراردادی که بر قانون حاکم تراضی شود دو دیدگاه کلی بین حقوق‌دانان، کشورها و مقررات بین‌المللی حاکم است: بعضی به کلی قائل به عدم پذیرش اصل حاکمیت اراده به‌جهت ارتباط مسئولیت مدنی با نظم عمومی شده‌اند و برخی حاکمیت اراده را در تعیین قانون حاکم، پیش و پس از ورود خسارت، به رسمیت می‌شناسند. و در نهایت، در فرض عدم توافق در نقض غیرقراردادی که شایع ترین نوع نقض این حقوق در فضای مجازی است از میان نظریات مختلف (از جمله قانون مقر، قانون محل وقوع فعل زیان‌بار و قانون محل حمایت) نظریۀ قانون دارای نزدیک‌ترین ارتباط به‌عنوان مناسب‌ترین راه‌حل در جهت تعیین قانون حاکم پیشنهاد شده است.}, keywords_fa = {تعارض قوانین,حق مؤلف,فضای مجازی,قانون حاکم}, url = {https://www.jlj.ir/article_37309.html}, eprint = {https://www.jlj.ir/article_37309_2ebb6dc533302c502cf972978b78b010.pdf} }
