The situation selection falls within the Prosecutor’s discretion that is done by conducting a preliminary examination. In this filtering process, three factors are taken into account, namely jurisdiction, admissibility and the interests of justice. Nevertheless, the Prosecutor prefers to extend its discretion behind the preliminary examination stage. Accordingly, the Prosecutor selects a situation not only to initiate an investigation upon conducing a preliminary examination but also to open a preliminary examination in itself. This article argues that the Prosecutor’s discretion to open a preliminary examination is limited to consider the jurisdiction requirement in a narrow manner, namely to exclude those crimes that are manifestly outside of the Court’s jurisdiction. Due to the role of preliminary examinations in combating the culture of impunity, the Prosecutor shall not adopt a conservative approach to open a preliminary examination.}, keywords = {Gravity,Jurisdiction,Admissibility,Situation,Expressive Mandate,Preliminary Examination,Prosecutor}, title_fa = {اختیارات دادستان دیوان کیفری بین‌المللی در آغاز فرایند ارزیابی مقدماتی}, abstract_fa = {دیوان کیفری بین‌المللی قادر نیست به تمام جرایم داخل در صلاحیت خود رسیدگی کند. گزینش کردن قضایا برای انجام تحقیقات از اختیارات دادستان دیوان است که طی فرایند ارزیابی مقدماتی صورت می‌گیرد. در این فرایند معیارهای سه‌گانۀ صلاحیت، قابلیت پذیرش و اقتضای عدالت مورد بررسی قرار می‌گیرند. با این حال دادستان مایل به تعمیم اختیار بررسی این معیارها به پیش از ارزیابی مقدماتی است. بر این اساس، دادستان دیوان نه‌تنها قضایای شناسایی و یا ارجاع‌شده را در مرحلۀ ارزیابی مقدماتی برای ادامۀ تحقیقات مورد غربالگری قرار می‌دهد، بلکه اقدام به گزینش‌‌کردن قضایا برای آغاز خود فرایند ارزیابی مقدماتی نیز می‌نماید. اختیاراتی که به‌صراحت در اساسنامۀ رم پیش‌بینی نشده است. این پژوهش با روش توصیفی و تحلیلی و از رهگذر بررسی اسناد حقوقی حاکم بر دیوان در کنار ارزیابی عملکرد دادستان دیوان در مقام پاسخ به این پرسش است که چنین اختیارات موسعی برای دادستان دیوان قابل‌شناسایی است یا خیر؟ پاسخ آن است که اختیار دادستان برای آغاز ارزیابی مقدماتی تنها محدود به بررسی مضیق معیار صلاحیت با هدف کنار نهادن جرایمی است که آشکارا از صلاحیت دیوان خارج هستند، اما در غیر این مورد، دادستان ملزم به آغاز ارزیابی مقدماتی می‌باشد. همچنین به‌دلیل کار‌کرد مهم ارزیابی مقدماتی در مقابله با بی‌کیفرمانی در آغاز‌کردن آن نباید رویکرد محافظه‌کارانه اختیار شود. توصیۀ این مقاله آن است که مرحلۀ پیش از ارزیابی مقدماتی باید به رسمیت شناخته شود تا امکان ضابطه‌مند شدن آن فراهم شود.}, keywords_fa = {شدت‌مندی,صلاحیت,قابلیت پذیرش,قضیه,کارکرد بیانی,ارزیابی مقدماتی}, url = {https://www.jlj.ir/article_245295.html}, eprint = {https://www.jlj.ir/article_245295_295fa97b550c102794dac458930038c9.pdf} }
