According to Article 10 of the Civil Code, the parties have full freedom of agreement, but this freedom is not absolute, and the supposed legal plans will change the structure of the contract.Now the question arises to what extent the legislator can play a role in the development and restriction of contractual freedom, given the economic, social, welfare and development needs by benefiting from special laws? And to what extent do law, custom and sharia prefer the public interest in preferring the necessities and pursuing public interests arising from the conflict of personal and public interest?To explain this important point in this article, coercion in the contracting board is divided into two types of elementary and structural coercion, and these results obtained by induction in the opinions of courts, scientific sources and judicial procedures indicate that: First, the courts force the parties to deviate from the conciliation results to a minimum or maximum, and the public interest is emphasized in the issuance of judgments as well as in judicial procedures. Secondly, the cases mentioned in the paragraphs of Article 190 of the Civil Code imply the obligation of elements to the extent that in the dominant aspect, in all agreements, they are present as a necessity in the composition and are irrevocable, but on the contrary, due to the structure of contracts. Certain special parties are required to comply with the rules arising from the requirements and restrictions that have arisen in the context of coercion arising from the elements and will require them to make the desired changes to elements of the contract.}, keywords = {Civil equality,Deprive of civil rights,Fundamental Rights,Bona fide contract,Competitive environment,Non-discrimination rules,public interest}, title_fa = {ارادۀ قانون‌گذار و نقش قاضی در اثربخشی به مفاد تراضی}, abstract_fa = { اصولاً اثربخشی به مفاد تراضی، به مجموعه عواملی غیر از ارادۀ طرفین مثل ارادۀ قانون‌گذار و نقش قاضی وابسته است. حسب مادۀ 10 قانون مدنی طرفین از آزادی کامل در توافق برخوردارند اما این آزادی مطلق نبوده و برنامه‌های مفروض قانونی، تغییراتی در ساختار قرارداد ایجاد خواهند کرد. حال این سؤالات مطرح است که قانون‌گذار تا چه حد می‌تواند با توجه به ضرورت‌های اقتصادی، اجتماعی، رفاهی و عمرانی با بهره‌مندی از قوانین خاص در توسعه و تضییق آزادی قراردادی نقش داشته باشد؟ و تا چه اندازه قانون، عرف و شرع در ترجیح ضرورت ها و حصول مصالح عمومی ناشی از تعارض نفع شخصی و عمومی، منافع عمومی را ترجیح می‌دهد؟ برای تبیین این مهم در این مقاله، اجبار موجود در هیئت قراردادی به دو نوعِ اجبار ارکانی و ساختاری تقسیم شده و این نتایج که با استقرا در آرای محاکم، منابع علمی و رویه‌های قضایی به دست آمده بر این برآمد دلالت دارد که اولاً دادگاه ها به‌صورت حداقلی یا حداکثری طرفین را به عدول از نتایج تراضی مجبور کرده و در صدور آرا و نیز در رویه‌های قضایی به‌ویژه در دعاوی مربوط به اعمال حقوقی بر منافع عمومی تأکید می‌شود. چون قدرت فوق ارادی حاکم بر نتایج تراضی طرفین درصدد تحصیل اغراض موردنظر مقنن برای بهبود زندگی مردم است. ثانیاً موارد مندرج در بندهای مادۀ 190 قانون مدنی دلالت بر اجبار ارکانی دارد تا آنجاکه با جنبۀ غالب، در کلیۀ توافقات، به‌عنوان ضرورتی در انشا موجود بوده و عدول‌ناپذیرند ولی در مقابل، به خاطر تبعیت ساختار عقود از ارکان آن، در قوانین خاص متعددی طرفین ملزم به رعایت ضوابط ناشی از الزامات و محذوراتی می‌شوند که در بستر اجبار ناشی از ارکان ایجاد شده و آن‌ها را ملزم به تغییرات موردنظر مقنن در عناصری از قرارداد خواهد کرد.}, keywords_fa = {مساوات مدنی,حقوق بنیادین,حسن‌نیت,محیط رقابت‌پذیر,قواعد رفع تبعیض,مصالح عامه}, url = {https://www.jlj.ir/article_245287.html}, eprint = {https://www.jlj.ir/article_245287_941368627ac34aaa8071f50f696ec22c.pdf} }
