Police detention or surveillance is contrary to the individual rights. In accordance with obvious rules, police at both American and Iranian systems of justice might arrest someone. This matter has an exceptional aspect. It is essential to observe two provisions in which include “visible crime” and “the principle of necessity”. A warrant is issued by judicial authorities to arrest someone is a requirement under American rules and it is possible to arrest someone at visible crime. Legislator of both legal systems has been considering rights like having promptly access to a lawyer since this proceeding to the presumption of innocence. Nevertheless, the accused has a right to be silent until a lawyer comes under American system of justice. On the other hand, fair and just interrogation such as realization of the accusation and its evidences to secure accused’ rights is predicted by both legal systems. In line with American rules, the realization of the arrest and predicting electronic devices to record accused’ statements is considered. Moreover, appropriate sanctions like exclusionary rule beside other sanctions at this legal system is predicted. Anyway, considering the regularity of the arrest and detention at this stage, both legal systems have put their efforts into reinforcing the accused’ rights.}, keywords = {Criminal Procedure,Crime Detection,Surveillance Rights,Iranian and American law}, title_fa = {مطالعه تطبیقی حقوق شخص تحت‌نظر در نظام دادرسی کیفری ایران و آمریکا}, abstract_fa = {یکی از اهداف قوانین دادرسی کیفری، حمایت از حقوق و آزادی‌های فردی است. از جمله اقدامات ناقض حقوق فردی، بازداشت پلیسی و یا تحت نظر است. پلیس در دو نظام حقوقی ایران و آمریکا طبق شرایط مشخصی حق دستگیری اشخاص را دارد. این موضوع جنبه استثنایی دارد. در حقوق ایران، رعایت دو قید «مشهود بودن جرم» و «احراز ضرورت» الزامی است. در حقوق آمریکا نیز برای اقدام به جلب و دستگیری علی‌الاصول صدور قرار توسط مرجع قضایی ضروری است و در جرایم مشهود، امکان دستگیری برای پلیس وجود دارد. با عنایت به اینکه این اقدام برخلاف فرض بی‌گناهی است، قانون‌گذاران دو نظام، حقوقی از قبیل دسترسی فوری به وکیل را فراهم کرده‌اند. با وجود این، در نظام حقوقی آمریکا متهم تا پیش از دسترسی به وکیل می‌تواند سکوت کند. از سوی دیگر در هر دو نظام برای تأمین حقوق متهم، تدارک بازجویی عادلانه و منصفانه و ضوابطی از قبیل تفهیم اتهام و ادلّه آن پیش‌بینی شده است. در حقوق آمریکا، تفهیم جلب و پیش‌بینی ابزار الکترونیکی برای ثبت و ضبط اظهارات متهم درنظر گرفته شده است؛ به‌علاوه، ضمانت‌اجراهای مناسبی از قبیل رد ادلّه، برای نقض حقوق دفاعی متهم پیش‌بینی شده است. در هر صورت با توجه به خلاف قاعده بودن بازداشت و دستگیری در این مرحله، هر دو نظام حقوقی تلاش خود را برای تقویت حقوق دفاعی متهم به کار گرفته‌اند.}, keywords_fa = {آیین دادرسی کیفری,کشف جرم,حقوق شخص تحت نظر,حقوق ایران و آمریکا}, url = {https://www.jlj.ir/article_22011.html}, eprint = {https://www.jlj.ir/article_22011_c97582dccb2493c108784473d0691ccd.pdf} }
