From the very beginning the legal character of the legislation, especially with regard to its first constituent article, proved highly controversial. The present paper, aiming to clarify the legislative character of this law, scrutinizes these issues and in the course of disputing the necessity of the reception of the total amount due in concordant transaction, reaches the final conclusion that the law is harmonious and in accordance with such transaction, this being conditioned by the presupposition that the contract observe the first article of the legislative law and state in writing that the edifice under agreement be transferred into the possession of the purchaser either “from the beginning,” “during the course of construction” or “after the completion of the edifice.” In the first instance the transfer will be unconditionally complete; in the second instance the transfer will be in a state of conditional pending and in accordance with the number of installments; and in the final instance the transfer will be in a state of conditional pending completed after the payment of the final installment.}, keywords = {Short Sale,Contract,Concordant Transaction,Pending Transaction,Contractual Obligation}, title_fa = {تبیین ماهیت حقوقی قرارداد پیش‌فروش ساختمان}, abstract_fa = {این مقاله در صدد یافتن ماهیت حقوقی قرارداد پیش‌فروش ساختمان بوده و به جهت اینکه در قانون مربوط، صحبت از مالکیت به عمل آمده، پس از طرح مسئله، در مباحث مقدماتی، بالضروره به تبیین مفهوم مالکیت و تعریف بیع در قانون مدنی ایران و فقه امامیه پرداخته شده است. در ادامه مباحث، دکترین حقوق درمورد قرارداد پیش‌فروش ساختمان و مطابقت آن با هریک از نهادهای حقوقی تعهد به بیع، بیع مشروط، بیع معدوم به تبع موجود، بیع معلّق، عقد صلح و قرارداد خصوصی تملیکی ارائه شده است و درنهایت، ضمن خدشه در لزوم شرطیت قبض تمامی ثمن در بیع سلم، این نتیجه به عمل آمد که قرارداد مزبور با بیع سلم قابل تحلیل و توجیه است. البته با ذکر اینکه واحد ساختمانی حسب انشاء طرفین با سه حالت مختلف «از ابتدا»، «در حین احداث و تکمیل» و «پس از اتمام عملیات ساختمانی» (مندرج در ماده 1) به مالکیت پیش‌خریدار درآید: در حالت اول  به‌صورت منجّز، در حالت دوم به‌صورت معلّق ( همراه با شرط تملیک تدریجی) و به نسبت اقساط پرداختی و در حالت سوم نیز به‌صورت معلق و به‌محض پرداخت آخرین قسط ثمن.}, keywords_fa = {پیش‎فروش,قرارداد,بیع,بیع سلم,بیع معلّق,تعهد به بیع}, url = {https://www.jlj.ir/article_11320.html}, eprint = {https://www.jlj.ir/article_11320_3e7e027f3352fac77452196ccb5f756b.pdf} }
